Catalan Ombudsman, Rafael Ribó, gives up his right to be judged only by the highest court in Catalonia ("aforamiento")

The The Ombudsman of Catalonia informed the President of the Parliament of Catalonia, Núria de Gispert, about his decision to give up his right to be judged only by the highest court in Catalonia. Such a privilege is granted by Law 36/1985 of 6 November, by which relations between the Spanish Ombudsman and other similar figures in the different regions are regulated. The Catalan Ombudsman considers this privilege an anachronism and suggests that this condition be abolished for all of the intended institutional positions in the constitutional system.

"Aforamiento": Special protection before the Law implying that the person enjoying it ("aforado") can only be judged by the Supreme Court or the highest court in its region.

Report on access of children to education and leisure outings and school camps

The Report on the rights of children to the education and leisure outings and school camps, presented by the Catalan Ombudsman in June 2014, confirms the existing social inequalities in access to children's leisure activities and territorial inequalities in provision of such activities. It also denounces the lack of rules governing the right of access to leisure activities in equal opportunities. The Catalan Ombudsman recommends measures headed for affordability, revitalization and promotion of leisure education, and support to entities concerned.

Health Department follows the recommendation of the Ombudsman and stops charging for the diagnostic tests

At the request of the Catalan Ombudsman also, the Health Department has instructed the Catalan Health Institute (ICS) to return the improperly collected amounts to those who request their refund. With this decision the right to obtain free of charge the integrated clinical history of public health system users is confirmed. Rafael Ribó is satisfied with this decision of the Health Department, who refuses a policy change giving legal coverage to the collection of the diagnostic tests abovementioned.

The Ombudsman investigates the legality of oil exploratory drillings on the Catalan coast

The Ombudsman has opened an ex-officio action to resolve whether the government has acted illegally in authorizing the existing oil exploratory drillings in Tarragona and if those violate environmental rights at national or European level. At present, drillings for oil in the area of Tarragona and there are some more at sight in the Ebro Delta and the Costa Brava. The Catalan Ombudsman urges the Spanish Ombudsman to proceed before the central government to clarify the case.

Implementation of the Istanbul Protocol in places of deprivation of liberty in Catalonia

Acting as the Catalan Authority for Prevention of Torture (CAPT), the Catalan Ombudsman has imposed himself the goal of having the Istanbul Protocol implemented in all places of deprivation of liberty in Catalonia within six months. Rafael Ribó has chaired a conference held on the occasion of International Day in Support of Victims of Torture and aimed on the implementation of the Istanbul Protocol, the first manual to document torture and its consequences.

Paper on the International framework of the Ombudsman

The Ombudsman's framework has found international consensus in a new study on the need to create and strengthen such institutions at national, regional and local levels in order to protect the rights and freedoms of citizens and to promote good governance. The paper, written by Professor of Constitutional Law, Joan Vintró, and Professor of Constitutional Law, Ignacio Aragonés, both from the University of Barcelona, has been made with the cooperation and assistance of the Catalan Ombudsman, Rafael Ribó.
